Be it enacted by the General Assembly of Virginia: 11 1. That the Code of Virginia is amended by adding a section numbered 15.2 - 1409.1 as follows: 12 § 15.2 - 1409.1. Liability of sanctuary cities for certain injuries and damages. 13 A sanctuary city shall be jointly and severally liable for the tortious injury to persons or property 14 caused by an illegal alien within such locality. The notice of claim in an action brought pursuant to this 15 section shall be filed pursuant to § 15.2 - 209. 16 For purposes of this section, "sanctuary city" means any locality that adopts any ordinance, 17 procedure, or policy that [ intentionally ] restricts the enforcement of federal immigration laws to less 18 than the full extent permitted by federal law [ with intent to thwart the execution of federal immigration 19 law ] .

Sanctuary City Status

Fairfax County is not a Sanctuary County or Sanctuary City.

It is important to note that the term "sanctuary county" or (more commonly) "sanctuary city" is not a legal term, and therefore the term means different things to different people. Generally, the term sanctuary city is given to cities in the United States or Canada that have policies designed to shelter illegal immigrants. The term generally applies to cities that do not allow municipal funds or resources to be used to enforce federal immigration laws, usually by not allowing police or municipal employees to inquire about an individual's immigration status.

The Fairfax County Board of Supervisors has not designated Fairfax County as a sanctuary county. In fact, a review shows no indication that the board has taken any action that could be interpreted as making Fairfax County a sanctuary county. County agencies and officials strive to comply with all federal requirements to determine an individual's immigration status.

On March 3, 2017 the U.S. Citizenship and Immigration Service announced on their website that starting from April 3, 2017 they will temporarily suspend premium processing for all H-1B visa petitions until further notice. H-1B visa holders pay Medicare and Social Security taxes, and are eligible for Social Security benefits and some language for a fast track for citizenship.
